Key takeaways

  1. 01India has the world's second-largest developer community on GitHub (21.9 million in 2025) and a tech sector NASSCOM expects to pass $315 billion in FY26.
  2. 02Clutch lists Indian software companies at $25–$49 an hour against $50–$99 in the USA; Accelerance puts senior South Asian developers at $35–$50.
  3. 03India is 9.5–10.5 hours ahead of New York and 4.5–5.5 hours ahead of London, so plan a daily overlap window and asynchronous handovers.
  4. 04India has no UK or EU adequacy decision, so personal data transfers need the IDTA, the UK Addendum or EU SCCs, plus a transfer risk assessment.
  5. 05Get IP in writing: under India's Copyright Act an assignment must be signed, and without a stated term and territory it defaults to five years and India only.

Outsourcing software development to India means hiring an Indian company to design, build or maintain your software, usually on a fixed-price, time-and-materials or dedicated-team contract. US and UK companies do it for senior talent at lower rates and for overnight progress. Success depends on time-zone overlap, a clear contract covering IP and data protection, and careful vetting.

India is the largest offshore software market for English-speaking buyers, and the numbers explain why. This guide covers what it costs, how the main engagement models work, how to make the time difference an advantage, what your contract must say under US, UK and Indian law, and how to vet a partner. Every figure is linked to its source. It is general information, not legal advice.

Why do US and UK companies outsource software development to India?

Three reasons come up again and again: talent, cost and coverage.

  • Talent at scale. GitHub's Octoverse 2025 counts 21.9 million developers in India, second only to the US, and says India added more than 5.2 million developers in 2025 alone. GitHub projects 57.5 million by 2030.
  • A mature industry. NASSCOM expects India's tech sector to cross $315 billion in FY26, with about 6 million people directly employed.
  • Proven at enterprise level. India hosts 2,117 global capability centers employing around 2.36 million professionals as of FY26, according to Nasscom and Zinnov. These are in-house engineering centers run by multinational companies, so many Indian engineers are already used to working with US and UK teams.

Cost still matters, but it is no longer the only driver. Deloitte's 2024 Global Outsourcing Survey of more than 500 executives found that 83% are using AI as part of their outsourced services. Buyers increasingly outsource for capability and speed, not just savings.

How much does it cost to outsource software development to India?

MarketTypical rateSource
India, custom software companies$25–$49 an hourClutch
USA, custom software companies$50–$99 an hourClutch
South Asia, senior developer (agency)$35–$50 an hourAccelerance
South Asia, architect (agency)$40–$70 an hourAccelerance
Eastern Europe, senior developer (agency)$55–$86 an hourAccelerance
India, senior freelancer$40–$70 an hourIndex.dev
UK, senior freelancer$80–$120 an hourIndex.dev
US, senior freelancer$100–$150 an hourIndex.dev

For context, the US Bureau of Labor Statistics puts the median pay of US software developers at $135,980 a year (May 2025), before benefits, office space, recruitment and management.

Two cautions. First, a low hourly rate is not a low project cost: a slower, less experienced team can spend twice the hours. Second, rates are falling and shifting. Accelerance reports a 16% reduction in South and Southeast Asian rates in its 2025 guide, with partners citing more fixed-price deals. Compare total cost of delivery, not rate cards.

Which engagement model should you choose?

ModelHow it worksBest forRisk sits with
Fixed priceOne agreed price for a defined scopeWell-specified projects: a website, an MVP with a clear feature listMostly the vendor
Time and materials (T&M)You pay for hours actually workedEvolving products, discovery-led work, ongoing improvementMostly you
Dedicated teamA team works only on your product, managed day to day by you or jointlyLong-term product development, scaling an in-house teamShared
Managed serviceThe vendor runs an outcome, such as maintenance or support, under an SLAHosting, maintenance, IT supportThe vendor, within the SLA

Accelerance calls time and materials "the most common model" and notes that fixed-price contracts put the risk of non-completion on the outsourcing partner. In practice, many buyers combine models: a fixed-price discovery and first release, then T&M or a dedicated team once the product is live.

Elgrith's outsourced web development and custom software development services start with a fixed scope and quote, so you know the cost before work begins.

How does the time difference with New York and London work?

India Standard Time is UTC+5:30 and India does not observe daylight saving time. The US and UK do, on different dates: US clocks change on the second Sunday of March and the first Sunday of November, and UK clocks change on the last Sundays of March and October.

Your officeIndia is ahead by (summer)India is ahead by (winter)9 a.m. your time isPractical overlap
New York9.5 hours10.5 hours6:30–7:30 p.m. in IndiaYour morning, India's evening
London4.5 hours5.5 hours1:30–2:30 p.m. in IndiaYour morning, India's afternoon

For London, the overlap is easy: your whole morning falls inside India's working day. For New York, it takes intent. Good teams keep a fixed evening window for calls, stand-ups and demos on Eastern Time, then work through your night, so you start the day with finished work and a written update.

Rules that make the gap work for you:

  1. Agree a fixed daily overlap window, one to two hours, and protect it.
  2. Write things down. Tickets with acceptance criteria, recorded demos and daily written updates.
  3. Give a local point of contact authority to unblock decisions without waiting a day.
  4. Watch the clock-change weeks. Between mid-March and late March, and late October to early November, the US and UK are out of step, and recurring meetings shift by an hour.

This is why Elgrith runs client teams in New York and London, with engineering at our New Delhi headquarters.

What should the contract cover: IP, NDA and data protection?

The contract is where outsourcing goes right or wrong. Have a lawyer in your jurisdiction review it. These are the points that matter most.

Intellectual property: get a written, worldwide assignment

Under India's Copyright Act 1957, an employer is the first owner of work made by its employees under a contract of service, so your vendor owns its staff's code by default, not you. To transfer it, the Act requires an assignment in writing, signed by the assignor. If the assignment does not state a period, it is deemed to last five years, and if it does not state a territory, it is presumed to cover India only. Your contract should therefore assign all rights in the code, designs and documentation to you, worldwide and in perpetuity, on payment.

US buyers should not rely on a "work made for hire" clause alone. The US Copyright Office's Circular 30 says commissioned work is only made for hire if it falls into one of nine categories and the parties sign a written agreement. Custom software usually does not fit those categories, so you need an express assignment as well.

Confidentiality

Sign a mutual NDA before you share anything sensitive, and make sure the main contract carries the confidentiality terms forward. Ask the vendor to confirm that every engineer on your project has signed confidentiality and IP terms with them.

UK GDPR and EU GDPR

India does not have a UK adequacy regulation, and it is not on the European Commission's list of adequacy decisions. So if an Indian vendor can access personal data, it is a restricted transfer. The ICO's guide to international transfers uses exactly this example, an Indian service provider, and says that if you rely on a safeguard you must also complete a transfer risk assessment.

In practice that means:

The simplest protection is to keep production personal data out of developers' hands altogether. Most software can be built and tested on synthetic or masked data.

US privacy and sector rules

The US has no single federal privacy law, but state laws apply. California's CCPA covers businesses with more than $25 million in revenue, among other thresholds, and its regulations require specific contract terms with service providers, including limits on using the data for anything other than named business purposes. If you handle health data, HIPAA requires a written business associate agreement with any vendor that touches protected health information.

India's DPDP Act

India's Digital Personal Data Protection Rules were notified in November 2025 and phase in over 18 months, with the core obligations on notice, consent, security and cross-border transfers applying from 13 May 2027. When an Indian vendor processes your data on your instructions, it acts as a processor, but expect contracts to start referring to DPDP obligations too.

Disputes

Choose a neutral seat for arbitration. India, the US and the UK are all parties to the New York Convention on enforcing foreign arbitral awards. Singapore is a common choice: India was again SIAC's third-largest foreign user in 2025.

How do you vet an Indian software development partner?

Use the same checklist you would use for a local agency, then add the offshore-specific checks.

  1. Live, relevant work. Ask for products you can open and use, and for references you can call.
  2. Verified reviews. On Clutch, only verified reviews count toward a firm's score, and each is checked by a human editor. Read the detail, not just the stars.
  3. The actual team. Meet the project lead and senior engineers who will work on your project, not only sales.
  4. Process and tools. Sprint cadence, ticketing, code review, automated tests, CI/CD, staging environments.
  5. Security posture. Ask about ISO/IEC 27001 certification or a SOC 2 report, and at minimum about access control, device security and offboarding.
  6. Communication. Written English quality, response times and a named point of contact in your time zone.
  7. Contract terms. IP assignment, data processing terms, code escrow or repository access, termination and handover.
  8. A paid pilot. Two to four weeks on a real, contained piece of work tells you more than any proposal.

Red flags

  • A fixed price for a complex product before any discovery.
  • Reluctance to let you meet the engineers, or frequent team changes.
  • No access to your own code repository until final payment.
  • Vague answers on where your data is stored and who can access it.
  • An IP clause that only transfers rights "on completion", with no term or territory.
  • Portfolio projects that are offline, slow or impossible to verify.
  • Rates far below the market bands above. Someone is paying for that discount, usually you, later.
